A Mississippi Supreme Court decision that two casinos cannot claim tax deductions under state law for the cost of prizes randomly awarded to members of rewards programs puts courts’ deference to tax agencies squarely in the crosshairs.  . . .

Don Griswold of Dakessian Law told Law360 the court finished the job started by the Mississippi Supreme Court in a 2018 case, King v. Mississippi Military Department, where the court had held that granting deference to an executive branch agency’s interpretation of a statute violated the state constitution’s separation of powers doctrine.
